Surrogacy in Michigan

Yeah so the laws in Michigan are the strictest in the entire nation. In fact if you do a google search you will see all sorts of things about surrogacy being illegal in Michigan; if you get caught doing it you can be charged with a felony punishable by 5 years in prison and a $50,000 fine. At first I panicked when I read that. Yeah the last thing I want is to go to prison for trying to become a parent. However upon closer investigation there seems to be ways to interpret the laws. I don't exactly understand the loopholes, but there are lawyers who do. I looked up Attorney Monica Linkner who says it is not illegal on her website. As we talk more with this potential surrogate, I'm sure I'll come to understand the legal process. I'm also hoping to have lunch or coffee soon with Sara from the blog Gas Passer. She's not blogging much these days, but she does plan to someday do gestational surrogacy in order to have a sibling for her daughter. In her case she has a friend who will carry her embryos, but it is still tricky to do in Michigan and good lawyers are needed. I know she has already met with a lawyer, so I'm hoping to learn some things from her.

Why is it illegal in MI, doesn't make any sense to me?

I hope Sara is able to give you some good info...I remember her talking about it on her blog, but I don't remember the details.
I think it's basically treated as an open adoption.
